Show full summary
  • Fossil fuel companies and workers would be protected from being denied Title III financial support because of activities like exploration, development, utilization, transportation, or sale. This protection would not apply when the assistance concerns the production of energy itself.
  • Federal agencies would face a narrower Section 101(c)(1) authority by inserting the phrase "other than for purposes of environmental protection" after "domestic energy supplies", limiting use of that authority for environmental protection purposes.
  • Title III assistance rules would include a new prohibition preventing the President from denying support under sections 301, 302, or 303 based on a recipient's engagement in fossil fuel energy activities.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Block DPA denials for fossil fuels

If enacted, the bill would add a new Section 306 to Title III of the Defense Production Act. It would prohibit the President from denying financial support under sections 301, 302, or 303 because a person is engaged in fossil-fuel activities like exploration, transport, or sale. That ban would not apply to financial support provided for the production of energy. The change would take effect upon enactment and govern Title III financial aid decisions.

Restrict DPA use for environment

If enacted, the bill would change the Defense Production Act. It would insert the words ", other than for purposes of environmental protection," after "domestic energy supplies" in Section 101(c)(1). This would mean agencies could not invoke that DPA energy authority for environmental protection when acting to ensure domestic energy supplies. The change would take effect upon enactment and apply to decisions under Section 101(c)(1).
