Summary

Ends the liability shield for vaccine manufacturers and would let people sue in state or federal court for vaccine injuries. The bill would overhaul parts of the National Vaccine Injury Compensation Program and create a new pathway that sends vaccine injury and death claims into ordinary civil litigation, with rules to prevent people from getting paid twice by a court and the compensation program.

Remove vaccine program election rules

If enacted, the bill would repeal the statutory election and related trial rules that governed when a petitioner could choose a civil lawsuit instead of the federal vaccine compensation program. That would change the legal path available to people and attorneys handling vaccine-injury claims. These repeals would take effect upon enactment.

Suing vaccine makers and providers

If enacted, you would be able to bring a private civil lawsuit in State or Federal court against a vaccine maker or administrator for injury or death from a vaccine. This change would apply even if you already filed a petition under the federal vaccine compensation program. If a court awards damages, you could not get compensation for the same injury from the vaccine program, and vice versa. The bill would also make related timing and procedure changes in the statute, effective on enactment.

Remove COVID-19 vaccine protections

If enacted, the bill would change the definition of "covered countermeasure" to explicitly exclude any vaccine used to mitigate, prevent, or treat COVID-19. Other listed countermeasures would remain covered. This exclusion would remove certain special statutory protections that apply to covered countermeasures for COVID-19 vaccines, effective on enactment.
