Exempts public school H-1B hires from the $100,000 non-processing fee. This bill would add a specific exemption to the $100,000 non-processing fee required by section 1(a) of Presidential Proclamation 10973 for H-1B petitions when the worker will be employed by a U.S. public school or public school district. The exemption is additive to existing exceptions in section 1(c) of the Proclamation and applies to specialty-occupation petitions under INA section 101(a)(15)(H)(i)(b).

Remove $100,000 H-1B fee for schools

If enacted, the bill would exempt certain H-1B petitions for workers hired by U.S. public schools or public school districts from a $100,000 non-processing fee. It applies to petitions for nonimmigrants coming to perform specialty-occupation work under INA section 101(a)(15)(H)(i)(b). Petitions that qualify would not need the $100,000 payment otherwise required by section 1(a) of Presidential Proclamation 10973. This exemption would be added on top of the exceptions already listed in section 1(c) of that Proclamation and would take effect upon enactment.
