S478119th Congress

Veterans 2nd Amendment Protection Act of 2025

Sponsored By: Senator John Kennedy

Introduced

Summary

This bill would bar the Department of Veterans Affairs from sending veterans' personally identifying information to the National Instant Criminal Background Check System unless a judge finds the veteran is a danger to themselves or others. It targets cases where the VA appoints a fiduciary to manage benefits and prevents reporting to NICS based solely on that fiduciary decision.

Limits VA sharing of veteran data

If enacted, the VA would be prohibited from sending a beneficiary's personally identifiable VA information to any Department of Justice entity for use by the national background-check system when the only reason is that VA pays benefits to a fiduciary for that beneficiary. Sharing would still be allowed if a judge, magistrate, or other judicial authority issues an order or finding that the beneficiary is a danger to themselves or others. The rule applies only to transmissions based solely on the fiduciary payment determination. This would not create new benefits, change who qualifies for VA payments, or add funding.
