Sponsored By: Senator Sen. Lee, Mike [R-UT]

Introduced

Summary

Federal removal and dismissal power for PLCAA cases would let gun industry defendants move qualifying state lawsuits to federal court and ask for dismissal. It applies to manufacturers, sellers, and trade associations under the Protection of Lawful Commerce in Arms Act (PLCAA).

Show full summary
  • Manufacturers, sellers, and trade associations: Could remove state civil suits to federal district court by asserting the case is a qualified civil liability action. The federal court can then decide if the case qualifies and dismiss it.
  • Plaintiffs in state court: May have their cases shifted to federal court and face dismissal earlier in the process.
  • State and federal courts: Federal district courts gain explicit authority to determine QCLA status and dismiss qualifying cases, removing those matters from state court dockets.

Federal removal option for gun suits

If enacted, this bill would let a firearms manufacturer, seller, or trade group move a civil suit filed in State court into federal district court when the defendant says the case is a "qualified civil liability action." The federal court where the case is moved would be able to decide whether the case is qualified and could dismiss it. This gives defendants a new procedural way to seek dismissal and may raise costs or uncertainty for plaintiffs. The change would take effect upon enactment.
