  • Families and survivors: Survivors of retired officers could receive federal death benefits when the retired officer dies from a targeted attack or becomes permanently and totally disabled because of their past service. This opens the program to people who left active duty but remained at risk.
  • Claims and timing: The change would apply retroactively to matters pending before the Bureau of Justice Assistance and to claims filed or accruing after enactment. An explicit exception makes the rule apply to actions taken on or after January 1, 2012.

Death and disability aid for retired officers

This bill would expand the federal Public Safety Officers' Benefits program to some retired law enforcement officers and their survivors. A retired officer would mean someone who left a public agency in good standing after serving as an officer, with or without pay. They would qualify only if death or permanent and total disability was the direct result of a targeted attack because of their service. If enacted, the change would take effect on the date of enactment and cover cases pending then or filed after. It would also apply to attacks on or after January 1, 2012.
