Midwives must disclose malpractice insurance status

Beginning October 1, 2026, Maryland nurse midwives and licensed certified midwives must tell patients in writing or by written electronic message if they have no professional liability insurance. You must get this notice at your first visit during any uninsured period, except for a free, incidental visit. The notice must be included with every informed consent before any procedure, and you sign it. The midwife keeps the signed notice in your record and must post a clear notice in the office when not insured.

Nursing homes and assisted living must disclose malpractice insurance

Beginning October 1, 2026, Maryland nursing homes and assisted living programs must tell you in writing or by written electronic message if they have no professional liability (malpractice) insurance. Prospective residents get this notice at the first visit during any uninsured period and at application if the provider is uninsured. Current residents must get a notice within 30 days after any lapse. The resident or prospective resident signs the notice, and the provider keeps it in the records. Facilities without coverage must post a clear on-site sign visible to residents and guests.
