Easier approvals for SUD facilities and beds

Beginning October 1, 2026, some residential substance use treatment centers do not need a full Certificate of Need to open. They must give the Health Services Cost Review Commission written notice at least 45 days before opening. The Commission must find the plan is not inconsistent with the State Health Plan, improves efficiency and effectiveness, and is in the public interest. Licensed centers that offer medically managed residential SUD care can also raise or lower bed counts with 45 days’ notice. This path applies when the change is tied to a merger or consolidation, a conversion to a nonhealth use, or is at a licensed SUD residential facility. The Commission must notify the facility of its decision within 45 days.
