Union grocery workers' rights protected

Beginning Oct. 1, 2026, food retailers cannot cut rights or benefits in a union contract unless the union agrees. Union-covered employees can sue and may recover attorney's fees.

Limits on algorithmic grocery pricing

Beginning Oct. 1, 2026, covered food stores and delivery apps cannot use dynamic pricing or your personal data to charge higher prices for tax-exempt foods. They also cannot use protected class data to withhold or deny offers or services. If a price is set by an algorithm or your data, the seller must show a clear notice next to the price. Normal promotions, loyalty deals, subscriptions, cost-based charges, price corrections, and outage resets are allowed, and you can choose data-for-discount offers. Personal data does not include de-identified or public information.

How pricing rule enforcement works

Beginning Oct. 1, 2026, the state must send a notice and give 45 days to fix a violation before it enforces these pricing rules. People cannot bring private lawsuits under the main pricing section, and the general private-suit law does not apply to these two sections. These violations are not crimes under the usual misdemeanor rule.

Which food retailers are covered

Beginning Oct. 1, 2026, a covered food retailer is a store with at least 15,000 square feet that sells food exempt from sales and use tax under §11-206(c). Only businesses that meet both rules are covered by these pricing and data limits. Smaller stores are not covered.
