Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Stronger ad rules and discipline for therapists

Beginning October 1, 2026, the Board sets standards for massage advertising and solicitation and defines banned content. The Board also sets ways to report problem ads. The Board may deny, reprimand, place on probation, suspend, or revoke a license or registration for violations, with a hearing. Mailing notices to patients about times for periodic appointments is not advertising.

Ban sexual content in massage ads

Beginning October 1, 2026, ads may not state or imply prostitution, escort, or sexual services, or run on sites known for those services. For online ads that break this rule, each day the ad is visible counts as a separate violation. Any violating physical sign or billboard that was still visible on October 1, 2026 must be removed by May 1, 2027. These rules apply to licensed therapists, registered practitioners, and third-party advertisers.

Show your name and license in ads

Beginning October 1, 2026, all massage ads must show the practitioner’s full licensed name and license or registration number. A business with many practitioners does not have to list every person, but any listed name must match the Board-issued license. You may use a trade name only if it is not misleading, and the ad also shows the practitioner or business name. The practitioner’s name must appear on bills, stationery, and receipts. Treatment records must clearly name who performed the service.
