Beginning July 1, 2027, Maryland fast-tracks Medicaid developmental disability services for a narrow group. You must be a dependent who moved to Maryland to live with an immediate family member after your caregiver in another state died or became incapacitated. You must have received home- and community-based or similar services in that other state for the past 10 years, and your Maryland family member must have lived here for the past 2 years. The Department can decide your eligibility and priority even before you establish Maryland residency. If eligible, you are placed in the Crisis Resolution priority and given access to waiver services through the reserve category that best matches what you had before. The law defines dependent and immediate family (spouse, parent, stepparent, grandparent, stepgrandparent, sibling, stepsibling, child, stepchild).
Beginning July 1, 2027, the Department must make an expedited eligibility decision within 30 days. It must prioritize completed applications when received and can use your records and evaluations from your prior state. It must finish each expedited decision within 60 business days after getting a complete application. The Department cannot relax legal eligibility rules or the rules for assigning priority during this fast-track process.
The law takes effect July 1, 2027. All fast-track rules and timelines start on that date unless another part of the law says otherwise.
