Home care agencies can train licensed nurses

Beginning October 1, 2026, residential service agencies that offer private duty nursing can hire a licensed nurse who lacks the Department’s required experience if the agency runs a state‑approved training and competency program. The agency must train the nurse to match patient needs, provide supervision by a qualified registered nurse, and assign a preceptor until the nurse proves competency. The agency must document completion in the personnel file and check competency at least once a year, or more often if the Department requires. The Maryland Department of Health must approve the training and the evaluations. These steps expand hiring while keeping patient safety protections in place.

Training rules do not change licensing

Beginning October 1, 2026, the new training and supervision rules for residential service agencies do not change nurse licensing, scope of practice, or standards of care. All existing professional licensing rules stay the same.
