Open investment work to diverse firms

Beginning June 1, 2026, the State Retirement and Pension System must share data so the certification agency can assess opportunities for minority- and women‑owned investment firms. The Office, with the certification agency and Attorney General, must design race‑ and gender‑neutral ways to expand access and report by December 31, 2031. These steps aim to open more brokerage and investment management work to diverse firms.

New MBE rules for cannabis and gaming

Beginning June 1, 2026, cannabis businesses, video lottery facilities, and sports wagering licensees must follow Maryland’s minority business goals, as allowed by the U.S. Constitution. The Office sets goals and procedures within 6 months after a license is issued. Video lottery licensees must make a good‑faith effort and are reviewed at least every 6 months; they must also try to meet stricter county rules when they exist. These sector rules end on July 1, 2031. The change creates more contracting chances for minority- and women‑owned firms and adds compliance duties for licensees.

MBE goals for offshore wind and PPPs

Beginning June 1, 2026, approved offshore wind projects and public–private partnerships must set minority business goals and procedures, as allowed by the U.S. Constitution. For offshore wind, goals are set within 6 months after OREC approval and developers file reports every 6 months. For PPPs, the Board of Public Works cannot approve a deal until goals and procedures are in place. These rules end on July 1, 2031. The change gives more subcontracting chances to minority- and women‑owned firms and adds compliance steps for developers and agencies.

Stronger MBE reporting and oversight

Beginning June 1, 2026, the state tightens MBE oversight and reporting. Agencies must file MBE and veteran‑owned reports within 60 days after the fiscal year and send quarterly updates; the Office files its yearly report by the 5th day of session and audits units every three years. A Governor’s Subcabinet meets each quarter and reports by December 31, 2025 and every December 1 after. The certification agency must deliver legal and disparity analyses by September 30, 2030, and other findings and subgoal reports by December 31, 2031. The Special Secretary must finish implementation policies by July 1, 2031.
