Midwives must disclose lack of insurance

Beginning October 1, 2026, nurse midwives and licensed certified midwives must tell patients in writing if they have no professional liability (malpractice) insurance or if coverage lapsed and was not renewed. They must give the notice at the first visit during the no‑insurance period, unless the visit is incidental care given free of charge. The notice must be part of each informed consent before any procedure. You must sign the notice, and the midwife must keep it in your record. Midwives without coverage must also post a clear sign at the practice.

Nursing and assisted living must disclose insurance

Beginning October 1, 2026, nursing homes and assisted living programs must tell residents and applicants in writing if they have no professional liability (malpractice) insurance or if coverage lapsed and was not renewed. Applicants get the notice at the first visit during any no‑coverage period and at application if there is still no coverage. Current residents must be told within 30 days after a lapse. The resident or applicant must sign the notice, and the facility must keep it on file. Nursing homes and facility‑based assisted living programs without coverage must also post a clear sign where residents and guests can see it.
