New ban on unsolicited loan checks

Beginning October 1, 2026, lenders cannot mail you a check for a secured loan unless you asked for it. You are not liable for an unlawful check unless you cash or deposit it. This ban does not cover convenience checks for an existing credit line or prescreened unsecured offers under federal law. Businesses that make personal loans count as creditors under this rule. On conviction, a violator faces a misdemeanor fine up to $500.

Unsolicited property purchase checks banned

Beginning October 1, 2026, a creditor may not send you a check as part of an unsolicited offer to buy your property. If you get an unlawful check, you are not liable for it unless you cash or deposit it.
