Companies can run clinical trials

Beginning October 1, 2026, a company that runs a registered clinical trial is not practicing medicine if it meets three rules. The trial must follow registered FDA, EMA, or similar protocols and ethics rules. Licensed individuals must make all medical decisions, and the company must not provide general medical care outside the trial.

New permit for research pharmacies

Beginning October 1, 2026, you must have a clinical research pharmacy permit to establish or run one. Each site needs its own permit. The Board only issues permits to pharmacies that operate under IRB‑approved research protocols that meet FDA or similar standards, are not open to the public, and dispense only to trial participants. Pharmacies must follow USP security and storage rules and any other Board requirements. The Board adopts regulations for standards, applications, inspections, and discipline.

Ownership rules for research pharmacies

Beginning October 1, 2026, licensed providers and others can own part of a clinical research pharmacy. A Maryland‑licensed pharmacist must be on‑site during all hours and oversee compounding and dispensing. Owners with a substantial stake may not steer patients to one pharmacist or get paid for referrals. Those owners may not serve as a clinical investigator for that pharmacy’s trials and may not override a pharmacist’s judgment. The Board may not discipline a nonlicensed owner based only on ownership.

Boards can probe unlicensed staff

Beginning October 1, 2026, health occupations boards can investigate claims that a clinical research pharmacy worker practices without a required license or with an unauthorized person. Boards can also investigate alleged violations under their rules for that profession.
