Clearer stormwater rules for farms

Beginning October 1, 2026, the Department of the Environment defines “agriculture” and farm uses in the Stormwater Design Manual. The guidance includes a standard plan for temporary parking and using pasture, meadows, or cropland to treat runoff. Montgomery County review of agritourism approvals

Beginning October 1, 2026, Montgomery County and its Soil Conservation District review how the county approves agritourism stormwater plans. They consult the Department of the Environment and look at how other counties handle these plans. They identify challenges, improve coordination, and recommend changes. They must report to the Governor and General Assembly by December 31, 2026. The review aims to improve clarity and coordination for agritourism operators.

Local enforcement of farm stormwater rules

Beginning October 1, 2026, local stormwater programs enforce stormwater rules on agricultural land. They must act with the advice and consent of the local soil conservation district. The State issues provisions and a model ordinance that require this local enforcement. Farm owners can face more inspections or compliance steps. The aim is stronger local water protection on farm properties.
