The law requires private health plans to cover insulin drugs and the supplies used to take insulin. You pay no more than $25 for a 30-day supply of insulin, per pharmacy or distributor, no matter the type or amount. You pay no more than $25 for a 30-day supply of dosing and emergency supplies (like meters, strips, lancets, ketone tests, glucagon, pen needles, and syringes), per pharmacy or distributor. Plans, pharmacy benefit managers, pharmacies, and distributors cannot charge or collect more than these caps. Deductibles, copays, and coinsurance cannot push your costs over the caps.
The state employee health plan must cover insulin and related supplies and follow the $25, 30-day caps. This requirement is in effect until July 31, 2025.
If your insulin is covered only by Medicare Part D, the state’s $25 caps do not apply. Your costs follow Medicare Part D rules instead.
If your plan is a qualified high-deductible plan, the $25 caps do not apply to the deductible until you meet the federal minimum deductible for HSA plans. This keeps your plan eligible for a health savings account. After you meet that amount, the caps apply.
