Funds for ethanol and fuel enforcement

The law supports two state funds. The Motor Fuel Tax Enforcement and Collection Cash Fund pays the Department of Revenue for motor-fuel enforcement and related costs for Agriculture and the State Patrol. The Legislature may transfer money from this fund to the General Fund. The Agricultural Alcohol Fuel Tax Fund, run by the Nebraska Ethanol Board, holds tax transfers, event fees, gifts, grants, and legislative money. The state may invest it, and the Board uses it for administration and programs.

New tax on dyed diesel fuel

Beginning October 1, 2026, Nebraska taxes certain dyed or noncompliant diesel at $0.0025 per gallon when it is sold, delivered, or used in the state. Each fiscal year, the first $140,000 of this tax goes to the Motor Fuel Tax Enforcement and Collection Cash Fund. All remaining money goes to the Agricultural Alcohol Fuel Tax Fund. Fuel sellers and distributors owe the tax and it can affect downstream prices.

Old ethanol and fuel laws repealed

The law repeals several prior ethanol and motor-fuel statutes listed in the act and replaces them with updated rules in this law. The repeals cover older sections on ethanol programs and fuel taxes and enforcement. Going forward, the new sections in this act control.

Smaller Ethanol Board, more producer seats

The Nebraska Ethanol Board now has seven members. Starting September 1, 2026, a business-designated seat must be an ethanol producer, and the Governor must appoint two producer members within 30 days after that date if needed. No more than four members may be from the same political party.

Fuel sellers: license and lower fee

Beginning October 1, 2026, fuel producers, refiners, importers, distributors, wholesalers, and suppliers must hold a petroleum release remedial action license to do business in Nebraska. Not having a license is a Class IV misdemeanor. If an applicant is an individual, the application must list a Social Security number. On the same date, the diesel cleanup fee is $0.003 per gallon; the motor-vehicle fuel fee stays $0.009 per gallon, and dyed diesel is covered. The Department of Revenue may keep up to $150,000 a year from these fees, prorated if for part of a year, to cover collection and administration costs that go to the Petroleum Release Remedial Action Collection Fund.
