Tighter court rules for unemployment appeals

The law sets strict steps to take a Board of Review unemployment case to court. After you start the case, you must serve the Administrator at the Carson City office within 45 days and leave one copy for each defendant. The Administrator then mails copies to each defendant. If you miss the 45-day service deadline, the court loses jurisdiction and must dismiss your case when the Administrator asks. If you served on time but made mistakes, the Administrator can move to dismiss within 45 days of getting your petition. You then have 10 business days to fix every listed problem or the court must dismiss. When served, the Administrator has 45 days to file an answer (or 45 days after a denied dismissal motion) and must file certified records of the case. These rules apply to petitions filed on or after the law’s effective date, which is upon passage and approval.
