Enforcement and broker exemption for solicited sales

Beginning January 1, 2026, breaking these appraisal, cancellation, notice, or disclosure rules is an unfair or deceptive act under Washington’s Consumer Protection Act. This lets the Attorney General and consumers use CPA enforcement and remedies. However, these appraisal and cancellation rights do not apply if either the buyer or the seller is represented by a licensed real estate broker.

Homeowners get rights in solicited sales

Beginning January 1, 2026, if a buyer seeks to buy your not‑listed property, you get new rights once you sign a contract. You can get an appraisal by a licensed appraiser you choose, and the buyer pays. The appraisal must be ordered within three business days. After you receive the appraisal, you can cancel without penalty within four business days. If you skip the appraisal, you can cancel without penalty within ten business days after signing. To cancel, send written notice by mail, email, telegram, or similar; notice counts when mailed, emailed, or delivered. The contract must show these rights in at least 10‑point bold, and you must acknowledge them in writing.
