The law takes effect June 11, 2026. The Governor appoints members by September 1, 2026, including three worker reps and three employer reps (one family home and one with 15 or fewer employees), plus a training rep and a parent rep. The DCYF Secretary and L&I Director also serve. Worker and employer members serve four-year terms after an initial 2-, 3-, and 4-year stagger. The first meeting is by October 1, 2026; the board elects a chair and meets at least quarterly. Six yes votes are needed for any recommendation. L&I provides staff, and members receive compensation and travel reimbursement under state law.
The law creates the Washington Child Care Workforce Standards Board. The board recommends minimum pay and job standards for child care workers, statewide or by region or role. First priorities are staffing, hiring, retention, and staff-to-child ratios. It can use wage data, collective bargaining agreements, worker testimony, and government tools to shape its advice. It sends its recommendations to the Department of Labor and Industries. The board cannot set licensing rules or suggest standards that are weaker than current law.
The board must post its findings and recommendations on L&I’s website. Each report shows how every member voted, and minority reports are allowed. The board follows state rulemaking and public records laws. It must comply with antitrust rules and can limit access to some data to stay within the law. L&I and DCYF must sign a data-sharing agreement by October 1, 2026.
