Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

College staff must report child abuse

Administrative, academic, and athletic department employees at public and private colleges must report suspected child abuse or neglect. This includes student employees. They must report at the first chance, and no later than 48 hours after they have reasonable cause. The report should include the accused person’s name, if known.

College attorneys keep client confidentiality

Attorneys employed by colleges or universities, and staff they supervise, do not have to report suspected abuse when the information relates to representing a client. They must still report when the information is not about client representation and they have reasonable cause. The law keeps lawyer confidentiality rules in place, including allowing disclosure to prevent likely death or serious harm. When reporting is required, they must follow the standard timeline: report at the first chance, and no later than 48 hours.
