Title removal makes manufactured homes real property

Beginning October 15, 2025, you can eliminate a manufactured-home title so the home becomes part of the land. Loans and liens then attach as real property, like a mortgage or deed of trust. If you keep the title, the home stays personal property with a separate lien. The Department of Licensing approves elimination only with required owner and secured-party consents, and after county recording the state cancels the title. After elimination, you must sell or lease the home with the land by deed or real estate contract. A lender does not have to consent unless it agreed in writing, and it can set reasonable steps and a fee. The law also clarifies who can apply, including landowners and leaseholders with a lease of 35 years or more.

Move or retitle an untitled manufactured home

Starting October 15, 2025, if you remove an untitled manufactured home and want a title (or it was destroyed), you must apply for a title, file an affidavit with landowner and secured-party consent, pay recording fees, provide a title-insurance certification dated within 10 days, and get moving permits. The department issues the title after the county records the documents, effective on the recording date. If you move the home to another site you own and reaffix it, you can apply for a transfer in location instead of getting a new title. The department records approvals in the counties for the origin and destination.
