Beginning July 27, 2025, the law does not punish sharing forged likenesses for art, news, education, religion, politics, or other public interest. It covers commentary, satire, and parody protected by the state or U.S. Constitutions. Internet services, phone carriers, and broadband companies are not liable just because a user posted the content. These protections apply when the provider did not create the content.
Beginning July 27, 2025, it is a crime to share a forged digital likeness as if it were real. A forged digital likeness is a picture or voice of a real person that is digitally changed to look or sound real, misrepresents them, and would likely fool a reasonable person. The crime applies when you intend to defraud, harass, threaten, intimidate, or do something else unlawful, and you knew or should have known it was fake. This is criminal impersonation in the second degree, a gross misdemeanor.
