Breaking these rules brings large civil penalties: $10,000 for the first violation and up to $1,000,000 after that. The attorney general, local prosecutors, or an aggrieved person may sue. A winning individual gets attorney fees, costs, and the greater of actual economic damages or $3,000. A violation is also an unfair or deceptive act under the Washington Consumer Protection Act. These enforcement rules start April 7, 2025.
Starting April 7, 2025, every covered product must show a warning that begins "WARNING DANGER: Deadly if ingested..." The label must include a skull-and-crossbones and cover at least 2% of the main front panel. Ads and online listings must show the same warning at least as large as the main product description. If the front panel is hidden or the item ships in bulk, the outer packaging must show a skull-and-crossbones. If a regulator rejects part of the label, sellers must use the closest allowed version.
Beginning April 7, 2025, sellers may only sell products with more than 10% sodium nitrite to commercial businesses. Before any sale, the buyer must state a business need and provide an EIN, and the seller must verify the EIN and that need. Simple self-attestations or checkboxes do not count. Sellers must keep each sale’s records and documents for three years. This applies to manufacturers, distributors, online and store retailers, and lessors.
