Beginning July 27, 2025, providers must keep your counseling information confidential, with clear exceptions. They can share with your written consent or with a personal representative if you die or are disabled. They can share for mandated reports, for subpoenas tied to complaints, or when state health privacy law allows. For some licensed counselors, they may share to prevent an imminent danger but do not have to. For some credentialed counselors, talk about planning a crime is not confidential, and they may testify if a minor was a crime victim.
