Workers can see and fix personnel files

The law lets you see your personnel file at least once a year. Your file includes job applications, reviews, closed discipline, leave and accommodation, payroll, and employment agreements. Private employers must give you a free copy within 21 calendar days; public agencies follow the public records law. A former employee is someone who left within three years; you can still request records and a signed discharge statement within 21 days that shows your discharge date and any reasons. Each year you can ask the employer to remove irrelevant or wrong info; if you disagree, you can add a written rebuttal, and former employees can rebut for up to two years.

Workers can sue for late personnel records

You can sue in superior court if your employer fails to give your complete file or required discharge statement on time. Damages per violation are $250 after 21 days, $500 after 28 days, and $1,000 after 35 days. Other violations are $500 per violation, and you can also get court orders and attorneys’ fees and costs. Before suing, you must give a written notice of intent to sue and wait five calendar days.
