Crimes that can bar care work

The law lists crimes that can disqualify people from jobs or volunteer roles with children, seniors, or people with disabilities. Examples include murder, rape, child molestation, kidnapping, assault, child abuse or neglect, and sexual exploitation of minors. A qualified entity can treat a listed conviction as disqualifying. The list also covers future renamed versions of these crimes.

Who needs care-work background checks

The law explains who must get fingerprint background checks in care settings. You count as an applicant if you seek paid, volunteer, or contract roles with access to children, seniors, or people with disabilities. It also covers prospective adoptive parents and some nonparental custodians. "Unsupervised" means not with another staff member or a relative or guardian. Peer counselors’ incidental contact with children at counseling sites is not unsupervised. A vulnerable adult includes any adult who cannot care for themselves.

Which organizations can run fingerprint checks

The law defines which businesses and agencies count as covered organizations for background checks. Qualified entities include any public or private group that provides or places care, and those that license or certify care providers. These organizations can request state and national fingerprint checks for staff, contractors, and volunteers. Examples include school districts, educational service districts, and public housing authorities.
