Baby changing stations in public buildings

The law requires public buildings that must have public restrooms to offer a baby changing station. It must be in a women’s and a men’s restroom, or in a gender-neutral restroom. If some restrooms lack a station, they must post clear signs to the nearest station. New public buildings built after the law’s effective date must comply. Existing buildings must add stations when a restroom remodel permit is issued and the work is $15,000 or more. A permit office or inspector can exempt a project if installation is not feasible or would break disability access rules. Single-patient, non-public restrooms in health care facilities are exempt. Industrial buildings and 18-and-over venues are not covered. Stations must meet state building code and are for children under 50 pounds.

Enforcement and owner options for stations

For a first violation, the city or county attorney sends a warning letter to the owner. After a warning, another violation is a class 2 civil infraction. No penalty applies if a station was removed under the law’s removal rule. An owner may remove a station that was installed lawfully if people do not use it as the manufacturer requires.
