For public works bids of $1,000,000 or more for the state, a state agency, a municipality, or a public college, prime contractors must name certain subcontractors. At bid time, you must list the names and proof of license for HVAC, plumbing, and electrical subs, or name yourself if you are licensed. If the agency finds license errors, you must fix them within 48 hours. Within 48 hours after bid time, you must list the subs for structural steel and rebar installation. You may list only one sub per work category; for bid alternates, say which sub goes with each alternate. If you fail to list, fail to name yourself when self‑performing, or list two subs for the same work, your bid is nonresponsive and void.
Swapping a listed subcontractor to help bid shopping or bid peddling is banned, before or after award. The original listed sub can seek money damages from the prime that signed the public contract and from the replacement sub, but not from the public owner. The original sub must prove bid shopping by a preponderance of the evidence. You may substitute a listed sub only if they refuse to sign, are bankrupt or insolvent, cannot perform, cannot get required license, bonding, insurance, or other statutory requirements, refuse or cannot provide a letter of bondability, or a court order or summary judgment bars them.
For covered projects, you only have to name subcontractors who will contract directly with you for HVAC, plumbing, electrical, structural steel install, and rebar install. Projects using design‑build, GC/CM, or job order contracting are exempt from these listing rules.
