More affordable homes on religious land

The law requires cities and counties to allow extra housing units on land owned or controlled by religious groups when the homes are affordable. Projects can be single-family or multifamily, including rehabs. They must either set aside at least 50% of units for households at or below 80% of county median income, or 20% for those at or below 50%. For qualifying renters, monthly housing costs, including utilities except telephone, cannot be over 30% of income. These protections last at least 50 years and operators must follow fair housing laws.

Developers must pay local fees

Religious owners or the developer leasing the site must pay all local development fees and mitigation costs. The law does not waive these charges. This raises project costs and can affect budgets and timelines.

Where these affordable homes can build

In certain fully-planning cities and counties, these projects must be inside an Urban Growth Area. If a religious group asks, the city or county must create policies to apply the density bonus. A city or county may require more than the 50% or 20% affordable set-aside to get the bonus. The law encourages builders to work with the local transit agency when it fits the site.
