2 provisions identified: 0 benefits, 1 costs, 1 mixed.
Lift and tramway operators must provide and maintain safe facilities and equipment. They must carry at least $1,000,000 in liability insurance for each accident. Private tramways that are not open to the public and run for free are exempt, but school and ski‑club tramways are not. Riders are presumed able to use the devices, and operators are not liable for failing to instruct them. Operators are not treated as common carriers, which lowers carrier‑level duties.
You must ski within your ability, control your speed and direction, and stay clear of grooming machines, vehicles, lift towers, and other equipment. Load and unload only at marked areas, and cross uphill tracks only at marked crossings. Do not throw objects or interfere with lifts, or do dangerous acts while riding uphill. The downhill skier must avoid people and objects below. If you leave marked or open runs, or if you are on foot or using a sliding device, you are responsible for collisions, injuries, or losses you cause. Unauthorized boarding is trespassing, and you cannot sue over trail or track conditions unless the operator was negligent.
