Washington bans deceptive sales emails

The law bans deceptive commercial emails to Washington residents. Beginning June 11, 2026, it is illegal to send or help send certain ads. Banned emails use another party’s domain without consent or hide the origin or path. It also bans subject lines the sender knows, or should know, are false or misleading. A sender is treated as knowing you are in Washington if the domain registrant can show that when asked.

Lower payouts for illegal spam

Beginning June 11, 2026, courts set damages for each illegal commercial email or text. A recipient gets $100, or their proven actual loss, whichever is higher. An interactive computer service gets $1,000, or its actual loss, whichever is higher. This lowers many per‑message payouts unless you can prove higher damage.

When these email rules apply

This timing rule explains when the new email rules apply. Beginning June 11, 2026, lawsuits filed on or after that date use the new rules. This applies even if the emails were sent earlier. Cases filed before June 11, 2026 keep the old rules.
