Condo warranty coverage and claims rules

When builders use the express‑warranty path, the warranty must cover all units and common areas and be acknowledged by the buyer. Owners, later buyers, and the association can make claims. Coverage lasts at least 1 year for workmanship and materials. It lasts 2 years for plumbing, electrical, and ductwork systems. It lasts 10 years for load‑bearing structural defects. Owners must start any breach claim under the state's condo warranty filing rule (RCW 64.90.680).

New warranty rules for small condos

Beginning July 27, 2025, for certain small condo types, a builder can avoid the state's implied warranties if they give an express warranty and insurance that meet the law. This covers accessory dwelling unit condos; buildings with 12 or fewer units and two or fewer stories; 12 or fewer units and three or fewer stories if one story is parking or commercial; or 12 or fewer units where no unit sits above or below another (balconies and small features allowed). Beginning June 11, 2026, it also covers units in new or converted buildings with 12 or fewer units and up to four stories. If the builder does not meet these conditions, they cannot use an express warranty to limit the state's implied warranties.
