Emergency albuterol at K-12 schools

Beginning in the 2027–28 school year, public, private, charter, and state‑tribal K‑12 schools can keep a school supply of albuterol. A licensed prescriber may write it in the school’s name with a standing order so staff can use it. If a student has a prescription on file, a nurse or trained staff may give it; without one, only the nurse may. Schools may use it on campus, buses, and field trips, and nurses or trained staff may carry a reasonable amount on trips. Parents are told right away after the school gives a dose or when the school learns a student self‑dosed. Donations require a prescription, and “albuterol” includes aerosol, powder, or solution for inhalers or nebulizers.

Protections for school staff and prescribers

School nurses and trained staff are not civilly or criminally liable when they give albuterol in substantial line with the student’s prescription or statewide standing order and the school’s written policies. Prescribers and pharmacists who supply schools are not liable unless the prescription was issued with conscious disregard for safety. Unlicensed school employees who did not agree in writing can file a written refusal to manage albuterol, and the district cannot fire or nonrenew them for that reason. The law does not create new private lawsuits or change other liability rules.

Statewide asthma policies and training

All districts must set asthma rescue procedures for each school. By January 1, 2027, the state updates one uniform procedure that teaches nurses and trained staff how to access and give a school albuterol supply; districts that choose a school supply must use that procedure. If parents provide backup medicine, the school keeps it at the student’s school where the student can reach it right away. Schools must also keep each student’s written treatment plan and related forms on file in an easy‑to‑reach spot for emergencies.
