Beginning July 1, 2027, continuing care communities that offer life care contracts must submit an actuarial analysis with registration. Renewals must include an analysis every other renewal, starting with the second renewal. The insurance commissioner sets review standards, tests results under moderately adverse conditions, and decides if the balance is satisfactory. The commissioner sets actuary qualifications, handles appeals, and gives written decisions and appeal notices. The department sets what the actuarial materials must include. Review materials are confidential and are not public records starting July 1, 2027. The office may ask for more actuarial information as needed.
The department keeps an online public list of registered continuing care communities, with links to any actuarial review results it receives. Unregistered entities may not call themselves a “registered continuing care retirement community,” a “continuing care retirement community,” or a “life plan community” in ads. This helps seniors and families check status and avoid misleading marketing.
The department issues a registration within 60 days after it gets a complete application, required fees, and documents. If the actuarial review is still pending but everything else is in order, the department may issue a provisional registration. A missed deadline by the department cannot delay a change of ownership or operation. Registrations last two years and cannot be transferred to a new owner. The department charges fees that cover its costs and the insurance office’s review costs. These registration rules take effect July 1, 2027.
