Criminal ban on nitrous oxide sales

Beginning June 11, 2026, it is a gross misdemeanor to sell, furnish, administer, distribute, give away, or offer any device, canister, tank, or receptacle that exclusively contains nitrous oxide, flavored nitrous oxide, or a chemical compound mixed with nitrous oxide. The rule targets sellers and distributors of these containers. The law defines “nitrous oxide” to include N2O, dinitrogen monoxide, dinitrogen oxide, nitrogen oxide, and laughing gas.

Medical, food, and auto uses allowed

Beginning June 11, 2026, key legal uses remain allowed. Licensed doctors, dentists, and veterinarians may use nitrous oxide for care, or direct others to do so. Food products that use nitrous oxide as a propellant can still be sold. Manufacturers may use nitrous oxide in real manufacturing or industrial operations. Lawful gas distributors may fill cylinders only for these exempt uses, and not for personal use. Sale and use for automotive purposes are also exempt.
