Limits on state collection of overpayments

Beginning July 1, 2025, the Department of Social and Health Services cannot collect an overpayment or other debt more than six years after the date of notice. Collection can continue past six years only if the Department started a court case or has an authorized administrative remedy in place. In those cases, the amount stops being a debt 10 years after the notice date, unless a court order lasts longer. For liens recorded under RCW 43.20B.080, the Department cannot collect after 20 years from the recording date.

Overpayment waivers for seniors and disabled

Beginning July 1, 2025, the Department may waive collection of unintentional overpayments for people in the aged, blind, or disabled assistance program. It may also waive collection for functionally disabled clients receiving services under chapters 74.39, 74.39A, and 71A.12 RCW. The Department may stop collection when a case meets the equitable estoppel standard in WAC 388-02-0495 (as of January 1, 2012). The Department can settle disputed claims and can partly or fully write off debts when recovery is not cost-effective. It must adopt rules that set when these waivers and write-offs apply.
