Beginning January 1, 2026, your employer may not refuse to hire, fire, demote, suspend, threaten, or retaliate against you because you are an actual or perceived hate crime victim. You can ask for reasonable safety changes at work, such as a transfer, new schedule, new contact information, or workstation and lock changes and safety procedures. The employer may deny a request only if it would cause significant difficulty or expense.
Beginning January 1, 2026, you can take reasonable job-protected leave if you or a family member is a hate crime victim. Leave may be intermittent or on a reduced schedule, with or without pay. Use it to get legal help, medical or mental health care, shelter or social services, counseling, safety planning, or to move. The law defines hate crime to include offenses in RCW 9A.36.080, including online offenses. Your employer can ask for proof, such as a police report, court papers, documents from an advocate or medical professional, or your written statement. If the leave was an emergency, you may provide proof within a reasonable time during or after the leave. Employers must keep your victim and leave information private unless you agree, a court or agency orders it, or the law requires it. Police and prosecutors must tell victims about this leave right when they take a report.
