Before the Department moves someone to work release, the parenting program, or graduated reentry, it must do a clinical check for substance use disorder. If the person has a disorder, the Department helps enroll them in treatment and starts care as soon as possible. Treatment includes access to medication‑assisted treatment and counseling. When clinically appropriate, the person gets fentanyl test strips and overdose‑reversal medicine at transfer. The Department also writes an individual treatment plan that matches each person’s needs, costs, and supervision.
The law raises partial confinement limits to as long as 18 months. Parents in the parenting program can serve up to the final 18 months at home on monitoring. In graduated reentry, general home detention can now cover the final 9 months. Some eligible people can transfer after at least 3 months served and may serve up to the final 18 months at home. These 3‑month/18‑month options do not apply to people with deportation orders, under ISRB review, or those serving for listed sex, violent, or crimes‑against‑persons offenses.
The law lets more caregivers join the DOC parenting program. You can qualify if you are expected to take over daily care and had an ongoing, substantial relationship with the child at the time of the offense. You must not be barred from contact by law or court order. The Department must also find that your participation is in the child’s best interest.
The Department sets who is eligible for work release and inspects each facility every year. It creates standard supervision rules and physical safety standards for new buildings. It reviews serious‑infraction records to make sure they are fair and consistent. Employers get written contact info and are asked to call the facility if a work‑release employee is absent. The Department also works with local governments and communities on a siting policy, notice, and good‑neighbor practices for new sites.
Changes to community parenting and partial confinement apply to people now serving time and future cases. Section 2 ends on January 1, 2026. Section 3 starts on January 1, 2026.
