Hospitals must keep records 26 years

Beginning July 27, 2025, hospitals must keep all medical records for at least 26 years from when each record was created. The rule applies to records made before and after that date, unless a hospital already destroyed them under the old law. A medical record includes all information from each visit, like notes, tests, and treatments. If a hospital closes, it must quickly set up a plan approved by the Department of Health to preserve the records. The Department sets rules on what information must be kept and can allow photographic copies under state law. Hospitals can store records on paper, microfilm, electronic, or other media, and must still follow any other record-retention rules.
