Beginning July 27, 2025, landlords cannot seize your personal property for unpaid rent, and any lease lien on your belongings is void. If a landlord takes or keeps your property without your written consent, you can recover its value and actual damages. After a written demand, an intentional refusal adds up to $500 per day, capped at $5,000. The winner can also get court costs and attorneys’ fees. Courts can waive or reduce bond when you sue to get your property back if your claim looks valid.
Beginning July 27, 2025, leases signed or renewed must follow new tenant-protection rules. A lease cannot make you give up your rights or remedies, block lawsuits or class actions, force an NDA about rent or fees, or allow a confession of judgment. It also cannot make you pay the landlord’s attorneys’ fees (unless a court awards them) or waive the landlord’s liability. You cannot be forced into arbitration unless the landlord pays all costs and the agreement is notarized. If a landlord knowingly uses a banned clause, you can recover actual damages, up to two times your monthly rent, plus court costs and attorneys’ fees.
Beginning July 27, 2025, agreements in an eviction case cannot make you pay charges that state law limits. Landlords also cannot threaten eviction over nonpossessory charges that the law limits. This protects tenants in unlawful detainer settlements or orders.
Beginning July 27, 2025, you get a five-day grace period for late fees. No late fees apply if you pay rent within five days after the due date. If rent is more than five days late, fees can start from the day after the due date. A lease also cannot require electronic-only rent payments. Landlords can still give a pay-or-vacate notice when rent is due.
