New $4,500 fees for reclamation permits

The law charges a $4,500 nonrefundable fee with applications to get a new reclamation permit, expand a permitted mine, revise a permit or reclamation plan, or combine permits. The department does not act on the application until the fee is paid.

Annual fees for mine permits, with caps

Beginning after June 30, 2017, each permit holder pays an annual fee. Most permits cost $3,500 per year. Public permit holders for mines used only for public works pay $2,500, unless a county cap applies. Counties with public works mines under 7 acres pay no more than $1,000 per mine per year. Fees are due before the permit is issued and each year on its anniversary.

Pay fees during appeals; tougher collections

Filing an appeal does not stop your duty to pay the annual permit fee. If you do not pay, the department can suspend mining, fine you, or cancel the permit. Past-due fees or fines can be sent to a licensed collection agency, which may add its own collection fees.

Faster feedback and privacy for applicants

Within 60 days of receiving your new, expanded, or revision application, the department must tell you what information is missing. The department must also keep your production records, mineral assessments, and trade secrets confidential and not release them under public records requests.

Reclamation fees fund state and local work

All fees collected under this law go into the state surface mining reclamation account. If the department gives enforcement duties to a county, city, or town, it may share fee money with that local government to support enforcement.
