By July 1, 2026, the Department of Corrections and the Department of Health adopt statewide behavioral health standards for correctional facilities. Starting July 1, 2027, Corrections follows these standards when providing care. The Department of Health conducts yearly inspections, reports any problems, and may give technical help. Corrections must send a corrective plan within 45 days after a report. By July 1, 2027, the agencies keep a biennial agreement for inspections, and Corrections reimburses Health for related costs. By July 20, 2030, and every four years after, they review and update the standards.
People in the prison-based Special Drug Offender Sentencing Alternative get a full substance use assessment while incarcerated. Their treatment is provided by Washington-licensed clinicians. This applies to care delivered inside state correctional facilities.
The law requires specific funding named in the omnibus budget by June 30, 2025. If that funding is not provided, this act is null and void.
