Penalties and short fix window for postings

Job applicants or employees can file a complaint or sue for posting violations. The director or a court can award $100 to $5,000 per violation, plus reasonable attorney fees and costs. The director can also add civil penalties up to $500 for a first violation or up to $1,000 for repeats, and order actual damages, reinstatement, or an injunction for harmed employees. Through July 27, 2027, an employer that gets written notice has five business days to fix a posting and ask third‑party sites to fix it; if corrected on time, no penalties or damages apply for that violation. These are the only remedies for these violations, and any lawsuit must be filed within three years. Filing a lawsuit ends the agency case, and you cannot recover twice for the same violation.

Job ads must show pay and benefits

Employers with 15 or more employees must list pay in every job ad. They must show a wage scale or salary range, or a fixed amount if that is the only offer. Ads must also include a general description of benefits and other pay. This covers direct and third‑party postings for specific open jobs, but not copies posted without the employer’s consent. If you are offered an internal transfer or promotion and ask, your employer must give the pay range or fixed pay.
