Stronger oversight of self-insured workers' comp

The law tightens oversight of employers that self-insure workers' compensation. The director must withdraw an employer’s self-insurance when serious problems exist. Examples include pressuring workers not to report injuries, calling job injuries off-the-job, paying less than owed, or ignoring corrective orders. Failing to pay required insolvency assessments, repeated bad-faith claim handling by municipal employers, or discriminating based on nondisabling conditions also trigger withdrawal. For a city or other municipal employer with a licensed third-party administrator contract that cannot be ended, the director may delay withdrawal only for the current contract term. The employer cannot renew or extend that contract to keep self-insurance.
