Water-sewer districts can sell personal items they find are not needed. No published notice is required for items worth under $5,400. For items at $5,400 or more, the district must publish a notice once a week for two weeks. The notice must describe the item, list the sale time and place, set the terms, say if the sale is public or private, and, if public, call for bids and allow rejecting bids for good cause.
If a district estimates land is worth over $7,500, it cannot sell it privately. When the estimated value is over $5,000, the value must come from three disinterested brokers’ written opinions or one licensed appraiser, done within the past six months. The district may not sell for less than 90% of that value. If no buyer pays 90% or more within 120 days, the board may pass a resolution and sell at public auction to the highest bidder. The valuation must be signed and filed with the district secretary for public inspection, and any sale notice must state the value and be published weekly for two weeks with property details, time, place, terms, and bidding rules.
