Cities and code cities must allow child care centers, and turning existing buildings into centers, in all zones except industrial, light industrial, and open space. They must also allow on-site child care in industrial and light industrial zones by conditional use, except near high-hazard facilities. Cities may choose to allow centers in even more zones. Local permit rules must be reasonable; they can cover pickup and drop-off for safety and traffic. The law uses the state definition of “child care centers” to decide which sites qualify.
Cities and code cities that update their comprehensive plan in 2027 under state law must add these child care siting rules in that 2027 update. All other cities must put the rules in place within two years after the section takes effect. This sets clear timelines so families see new child care options sooner.
