The law expands what counts as a health facility. It now includes behavioral health hospitals, drug and alcohol treatment centers, and facilities run by local governments. These facilities are covered by state health planning and certificate-of-need rules.
The Office of Financial Management creates a statewide health resources strategy. It sets goals, inventories services, and projects need by region. It includes a data plan, trend review, a rural plan, and uses health equity. OFM holds public hearings before the draft and the final plan. A preliminary report is due July 1, 2026. The final strategy is due December 31, 2027, with projections through 2032, and updates every four years starting January 1, 2033.
OFM sends the statewide strategy and regional plans to the Department of Health to guide certificate-of-need reviews. OFM cannot rate the merits of individual projects. The Department cannot adopt rules in response to the 2027 strategy. The Department keeps sole authority to decide certificate-of-need applications.
